<h1>Application for Creditor Meeting Under Section 391(1) Must Be Initiated by Judge's Summons with Affidavit</h1> An application under section 391(1) of the Companies Law for convening a meeting of creditors or members must be initiated through a Judge's summons, supported by an affidavit. This affidavit should include the proposed compromise or arrangement as an exhibit. The summons is generally moved ex parte, except as specified in rule 68. The prescribed forms for the summons and affidavit are Form No. 33 and Form No. 34, respectively, according to the Company Court Rules of 1959.
