of <h1>Applications under Sections 542/543 of Companies Law require a summons in Chambers per Rule 260 of Company Court Rules.</h1> Applications under sections 542 or 543 of the Companies Law, as per Rule 260 of the Company Court Rules, 1959, must be initiated by a summons returnable in Chambers. The summons should specify the declaration or order sought and the grounds for the application. It must be served on each individual against whom an order is sought at least eight days before the hearing. Filing an affidavit or report before the summons return is not required. The summons should follow Form No. 120 or 121, with necessary modifications.
