Rule 119 Details Process for Transferring Winding-Up Proceedings Between Courts Using Form No. 54
Rule 119 of the Company Court Rules, 1959, outlines the procedure for transferring winding-up proceedings. If a High Court has issued a winding-up order, the Official Liquidator, a creditor, or a contributory can apply to transfer proceedings to a subordinate District Court, another High Court, or a subordinate District Court. Applications for transferring proceedings from a District Court to a High Court or another District Court must be filed with the High Court. Notice of such applications must be given to the relevant Official Liquidators and parties involved, potentially requiring advertisement. Transfer orders are issued using Form No. 54.
