<h1>Application to Stay Suits Against Companies Allowed Under Rule 71 and Section 391(6) with Notice Requirements if Petitions Exist.</h1> Rule 71 of the Company Court Rules, 1959, under the Companies Law, allows for an application to stay the commencement or continuation of any suit or proceeding against a company under section 391(6). This application can be made ex parte through a Judge's summons. However, if there is an existing petition for winding up the company or a petition under sections 397 or 398, notice of the stay application must be provided to the petitioner involved in those proceedings.
