Employee's compensation: statutory calculation methods for death, total and partial disablement, temporary payments, medical and funeral reliefs
Section prescribes scales and methods for calculating employee compensation for workplace injury: death compensation equals fifty percent of monthly wages multiplied by the relevant factor or a notified minimum, and permanent total disablement equals sixty percent similarly, with Central Government able to enhance amounts by notification. Permanent partial disablement is assessed by Fourth Schedule percentages or pro rata loss of earning capacity as medically certified, aggregated but capped at total disablement amount. Temporary disablement attracts half-monthly payments of 25% of monthly wages subject to waiting periods and deductions. Employers must reimburse actual medical expenditure and deposit prescribed funeral sums on death; foreign awards reduce domestic compensation.
