Fatal workplace accidents: authority may require employer statement, compel deposit if admitted, and enable dependants to claim compensation
Section 88 authorises a competent authority, upon information of an employment-related fatality, to require an employer to submit a prescribed statement of circumstances and to state whether the employer accepts liability to deposit compensation; if the employer accepts liability he must deposit compensation within thirty days, and if he disclaims liability he must state grounds for disclaimer. The competent authority may, after inquiry, inform dependants of their right to claim compensation and, where a dependant cannot engage counsel, may provide an advocate from the state panel to assist in pursuing a claim.
