Medical board referrals determine disablement assessments, review grounds, and prescribed appeal routes for insured persons and the Corporation. Determinations of permanent disablement, loss of earning capacity, and provisional or final status are to be made by a medical board; the Corporation must refer claims for permanent disablement to the board and re-refer provisional assessments before their expiry. A medical board may review decisions for non-disclosure or misrepresentation and for substantial unforeseen aggravation, subject to opinion of substantial injustice and prescribed minimum waiting periods. On review the board may exercise original powers including provisional assessment. Appeals from board decisions lie to a medical appeal tribunal or directly to the Employees Insurance Court, with a further right to second appeal where the tribunal is first chosen, but appeals are barred where commutation has been paid on the board's decision.
