<h1>Employer duty to implement court-ordered remedial safety measures after workplace conviction; penalties for post-deadline non-compliance</h1> Where an employer of a mine, factory or dock is convicted of an offence under this Code, the court may order in writing that the employer, within a specified (and extendable) period, take specified remedial measures to remedy the matters giving rise to the offence; during that period (or any extension) the employer is not liable under the Code for continuance of the offence. If, on expiry of the period or extension, the court's order has not been fully complied with, the employer is deemed to have committed a further offence and is punishable with imprisonment for a term up to six months, or with a fine up to one hundred rupees per day for each day of non-compliance after expiry, or with both.
