<h1>Exemption from provision regarding employment permits managers to authorize work contrary to hours rules during mine emergencies, subject to reporting.</h1> Section 69 allows the mine manager, where there is an emergency, accident, act of God, or urgent breakdown-related work, to permit persons to be employed in contravention of statutory hours and certain employment provisions when necessary to protect mine or worker safety; such permission may incidentally affect mineral production but must not exceed limits necessary to avoid serious interference with ordinary workings. Any action taken under this power must be recorded with circumstances and reported to the Chief Inspector-cum-Facilitator or Inspector-cum-Facilitator. The managers exercise of discretion is constrained by necessity, proportionality, and mandatory recording and reporting obligations.
