Inter-State migrant workers' working conditions require employers to provide accommodation, safety, cross-State fatality reporting, and equal social security benefits
Duty imposed on every contractor or employer of an establishment employing inter-State migrant workers to ensure suitable working conditions for such workers given they work outside their home State, thereby obliging provision of accommodation, safety and work environment adapted to their migrant status. Duty to report fatal accidents or serious bodily injury affecting such workers to the specified authorities of both States and to the worker's next of kin, thereby triggering cross-State notification and potential regulatory or investigatory action. Duty to extend all benefits available to other workers of the establishment, including entitlements under the Employees' State Insurance Act and the Employees' Provident Funds Acts and provision of medical check-up facilities, thereby securing parity of social security and health benefits.
