Occupational safety breaches causing death or serious injury attract imprisonment, fines and mandatory victim compensation directions. Non-compliance with duties under the Code causing an accident attracts criminal penalties: if death results, up to two years' imprisonment or a fine of not less than five lakh rupees or both; if serious bodily injury results, up to one year's imprisonment or a fine between two and four lakh rupees or both. Courts must allocate at least fifty per cent of any fine as compensation to the victim or legal heirs in death cases. Repeat convictions attract double the original punishment.
