<h1>Prosecution of mine owners, agents or managers limited to specified officials; authorised approval and due-diligence precondition required</h1> No prosecution for an offence under this Code against an owner, agent or manager of a mine may be instituted except at the instance of the Chief Inspector-cum-Facilitator, the District Magistrate, or an Inspector-cum-Facilitator authorised in writing by the Chief Inspector-cum-Facilitator; this confines locus standi for initiating prosecutions to those specified authorities and prevents private or other authorities from initiating proceedings. The authorised official must first be satisfied that the owner, agent or manager failed to exercise due diligence to prevent the offence, creating a substantive precondition for prosecution. For offences arising in the course of technical direction and management of a mine, the District Magistrate requires prior approval of the Chief Inspector-cum-Facilitator before instituting prosecution, thereby centralising oversight for such prosecutions.
