Occupational safety and health Code allows compounding of specified offences with set composition rates and limited exceptions
Composition of certain offences under the occupational safety and health framework permits notified government officers to compound specified penalties and offences, allowing settlement before or after enquiry or prosecution; composition payable is fixed as a portion of the maximum penalty or fine and, once compounded, results in discharge and bar to further proceedings. Failure to comply with a composition order attracts an additional monetary penalty. Composition proceeds are to be credited to the fund for unorganised workers. The compounding mechanism is unavailable for second or subsequent offences within three years where the earlier offence was compounded or resulted in conviction.
