Section 360 allows courts to release certain offenders on probation of good conduct instead of immediate sentencing. This applies to first-time offenders convicted of minor offences, considering age, character, and circumstances. Magistrates of the first class handle cases referred by second-class Magistrates. Appellate or higher courts can revise or set aside probation orders. The section ensures offenders have a fixed abode and allows for apprehension if probation conditions are breached. It does not override the Probation of Offenders Act, 1958, or the Children Act, 1960.
