Amendment to Section 121: Companies Act and Competition Act Exclusions for Multi-State Co-Operative Societies Explained.
Section 121 of the Multi-State Co-Operative Societies Act, 2002, states that the Companies Act, 2013, and the Competition Act, 2002, do not apply to multi-state co-operative societies. These societies, whether registered or deemed registered under this Act, must not engage in monopolistic or restrictive trade practices as defined by the Monopolies and Restrictive Trade Practices Act, 1969. The section was amended in 2023 to substitute the reference to the Companies Act, 1956, and the Monopolies and Restrictive Trade Practices Act, 1969, with the current applicable laws.
