Multi-State Co-Operative Societies Act, 2002: Ensures Continuity for Societies, Bye-Laws, and Legal Proceedings; Section 86 on Winding Up
The Multi-State Co-Operative Societies Act, 2002 repeals the Multi-State Co-Operative Societies Act, 1984, but ensures continuity of actions taken under the previous Act. Existing multi-state co-operative societies registered under prior laws will be considered registered under the new Act, maintaining their bye-laws unless inconsistent with the new provisions. Appointments, rules, orders, and proceedings under previous Acts will be treated as under the 2002 Act, except for registration cancellations, which are considered under section 86 for winding up. The Act applies to pending applications for registration or amendment of bye-laws, and ongoing legal proceedings will continue as before.
