Transfer of pending company proceedings: Tribunal assumes jurisdiction, limited appeals preserved and abated industrial references may be refiled. On constitution of the Tribunal, matters and proceedings pending before the Company Law Board or pending under the Companies Act before District Courts or High Courts transfer to the Tribunal, which may dispose of them in accordance with this Act or proceed de novo. Appeals from prior Company Law Board orders may be taken to the High Court on questions of law within the prescribed period with possible extension for sufficient cause. Court-supervised winding up proceedings remain with the courts and retain their incidents and appellate routes. Appeals or references before industrial reconstruction authorities stand abated, but companies may refer to the Tribunal within the prescribed period without fees if abated.
