New Companies Bill Excludes Time from Winding Up in Limitation Period Calculations, Overriding Limitation Act 1963
Clause 358 of the Companies Bill, 2011, stipulates that when calculating the period of limitation for any suit or application filed in the name of a company undergoing winding up by the Tribunal, the time from the commencement of the winding up until one year after the winding up order is issued will be excluded. This provision overrides the Limitation Act, 1963, and any other prevailing laws.
