Service of Process under Companies Law requires registry notification of unserved notices and seven-day re-service obligation
Rule 107 of the NCLT Rules prescribes procedural steps for fresh service when a notice under rule 105 is returned unserved: the Registry must immediately post the fact and reason on its notice board, and the applicant, petitioner or authorised representative is required to take steps to effect fresh service within seven days from that notification. The rule imposes a registry notification obligation and a mandatory short statutory timeframe for re-service, allocating responsibility to the initiating party or their authorised representative to remedy non-service promptly.
