Rule 38: Serving Notices via Post, Email, or Courier with Proof Required; Tribunal May Allow Alternative Methods.
Rule 38 of the National Company Law Tribunal Rules, 2016, outlines the procedures for serving notices and processes. Notices may be served by post, courier, email, hand delivery, or by the party themselves, as directed by the Tribunal. Proof of delivery must be filed with the Registrar, including an affidavit of service. The Tribunal may direct alternative service methods based on circumstances. Notices can also be served to authorized representatives, deemed as proper service. Any charges for alternative service methods must be deposited by the petitioner or applicant with the Tribunal's registry.
