<h1>Award of costs in company law proceedings: Tribunal may order payment of opponent's legal expenses or impose exemplary costs.</h1> Rule 113 authorises the Tribunal to allocate litigation costs: it permits awarding costs to meet legal expenses of a respondent or a defaulting party, and empowers the Tribunal to direct an appellant or respondent to bear the other sides litigation costs in appropriate cases. The rule further empowers imposition of exemplary costs where there is abuse of process. The provision vests broad tribunal discretion to shift costs and to penalise misuse of proceedings, thereby affecting parties financial exposure to legal fees and serving as a deterrent against procedural abuse.
