of <h1>Rule 39 NCLT Rules 2016: Evidence via Affidavit Allowed; Cross-Examination Possible for Justice; Must Use Form NCLT.7</h1> Rule 39 of the National Company Law Tribunal Rules, 2016, governs the production of evidence by affidavit in proceedings before the Tribunal. It allows the Tribunal to direct parties to present evidence via affidavit. However, if deemed necessary for natural justice, the Tribunal can order cross-examination of any deponent on conflicting points, potentially using video conferencing or other means. This can be initiated upon application by any party involved. All affidavits submitted must adhere to the prescribed format, Form No. NCLT.7.
