Evidence procedure: parties may give evidence by affidavit; cross-examination allowed for natural justice via video or other means. Rule 39 permits the Tribunal to require parties to give evidence by affidavit, allows the Tribunal, in the interest of natural justice and on application, to order cross-examination of any deponent-including by information and communication technology such as video conferencing-and requires every affidavit filed to be in Form No. NCLT.7.
