Employer must pay worker full last-drawn wages during appeal against reinstatement award if worker remained unemployed
Where a Tribunal or National Industrial Tribunal awards reinstatement and the employer prefers proceedings against that award in the High Court or Supreme Court, the employer is required to pay the worker full wages last drawn, inclusive of any admissible maintenance allowance, for the period of pendency in the High Court or Supreme Court provided the worker was not employed during that period and has filed an affidavit to that effect; the Court may, however, direct that no wages be payable for any period or part thereof if it is satisfied that the worker was employed and received adequate remuneration during that period.
