Lay off, retrenchment and closure rules exclude small, seasonal or intermittently worked factories, mines and plantations. Sections 67-69 on lay off, retrenchment and closure do not apply to establishments covered by Chapter X, establishments with an average workforce under fifty per working day in the preceding calendar month, or establishments of a seasonal or intermittently worked character; the appropriate Government's decision on seasonality or intermittent work is final. 'Industrial establishment' for these provisions is confined to a factory, mine, or plantation as defined in the respective labour statutes.
