Auction sale of company assets in liquidation: auctioneer must remit gross proceeds to liquidator before expenses are paid
Where a Company Liquidator sells property forming part of a company's assets through an auctioneer or other agent, the gross sale proceeds must, unless the Tribunal orders otherwise, be paid over to the liquidator by the auctioneer or agent. The charges and expenses connected with the sale are to be paid thereafter to the auctioneer or agent in accordance with any scales fixed by the Tribunal, thereby prioritising remittance of gross proceeds to the liquidator and subjecting sale-related charges and expenses to Tribunal-fixed scales and sequencing.
