Creditor voting rights at insolvency meetings: chairman may admit or reject proofs for voting, with appeal and 'objected to' votes
The chairman of a meeting of creditors or contributories is empowered to admit or reject a creditor's proof solely for purposes of voting, and that decision is appealable to the Tribunal, thereby enabling judicial review of voting eligibility determinations. Where the chairman is in doubt as to whether a proof should be admitted or rejected, the proof must be marked as 'objected to' and the creditor permitted to vote, with the vote remaining effective unless and until the objection is sustained, in which case the vote is treated as invalid.
