Bills of costs in tribunal winding-up: professionals must submit within four weeks or forfeit claims; limited restoration before final dividend
Requires every authorised representative, accountant, auctioneer or other person engaged by the Company Liquidator in a Tribunal winding up, on request, to deliver a bill of costs or charges to the Company Liquidator sufficiently before declaration of a dividend. Failure to submit the bill within four weeks of receipt of the request, or within any extended time allowed by the Tribunal, mandates the Company Liquidator to declare and distribute dividends without considering that claim, and the claim stands forfeited. The Tribunal may, before declaration of the final dividend, restore a forfeited claim for good cause and direct acceptance of the bill without affecting dividends already declared; the request must be in Form WIN 95 and served personally or by registered post or speed post.
