<h1>Withdrawing an advertised winding-up petition: tribunal leave and rule 7 hearing-date limits, preventing unilateral discontinuance</h1> A winding up petition, once presented, cannot be withdrawn except with the Tribunal's leave, and such leave is subject to compliance with any Tribunal directions, including orders as to costs, thereby restricting unilateral discontinuance of proceedings and preserving the Tribunal's control over withdrawal terms. Where the petition has been advertised in accordance with rule 7, an application seeking leave to withdraw it must not be heard before the hearing date stated in the advertisement, thereby ensuring that advertised proceedings are not withdrawn in advance of the notified hearing schedule.
