Tribunal sets case-specific fees and applies uncontested cost scale in winding-up matters under 2020 rules
Nothing in the Companies (Winding Up) Rules, 2020 restricts the Tribunal from fixing a fee for any matter where, in a particular case, it considers such fixation necessary in the interest of justice; this permits case-specific fee determination notwithstanding the rules. Where the contest in a matter has not been of a substantial nature, the Tribunal may direct that costs be awarded on the uncontested scale; this limits recoverable costs by treating the proceeding as effectively uncontested for costing purposes.
