<h1>Late proof of creditor debt in liquidation: can claim missed dividends from remaining funds, but can't reopen earlier distributions</h1> A creditor who has not proved its debt before the declaration of a dividend remains entitled, upon subsequently proving the debt, to receive any dividend(s) it previously failed to obtain out of monies then in the hands of the Company Liquidator that are available for dividend distribution, provided such payment is made before those monies are applied toward any future dividend(s). The creditor is not entitled to disturb or reopen the distribution of any dividend declared before the debt was proved solely on the ground of non-participation in that earlier distribution.
