Recovery of unpaid contributory dues and pre-winding-up call money in liquidation, via affidavit-backed application and 7-day notice order
Where any money is due to the company from a contributory or from the estate represented by a contributory, other than amounts due on calls made after commencement of winding up but including amounts due on calls made before commencement, the Company Liquidator is authorised to apply to the Tribunal, supported by affidavit, seeking an order directing payment of such sums. The application must be served on the contributory by registered post or speed post with not less than seven days' notice before the date fixed for hearing, enabling the Tribunal to compel recovery of pre-winding-up call liabilities and other outstanding dues from contributories through summary adjudication.
