Omission to assist public servant carries criminal penalties, increased where assistance is lawfully demanded for process, prevention or arrest. Omission to assist a public servant when legally bound to do so is punishable by a short-term custodial sentence or a fine, or both; higher penalties apply where a public servant legally competent demands assistance for executing court process, preventing an offence, suppressing a riot or affray, or apprehending a person charged with or guilty of an offence or who has escaped lawful custody.
