Section 98: Severe Penalties for Selling or Disposing of a Child for Prostitution or Immoral Purposes
Section 98 of the Bharatiya Nyaya Sanhita, 2023, addresses the offense of selling or disposing of a child for prostitution or any immoral purpose. It stipulates that anyone who sells, hires, or disposes of a child with the intent or knowledge that the child will be used for such purposes can face imprisonment for up to ten years and a fine. A presumption of intent exists when a female under eighteen is disposed of to a prostitute or brothel manager. 'Illicit intercourse' is defined as sexual relations outside recognized marriage or quasi-marital unions by personal or community law.
