Section 8: Fines and Imprisonment in Default of Payment; Imprisonment Varies by Fine Amount, Not to Exceed One Year
Section 8 of the Bharatiya Nyaya Sanhita, 2023, outlines the provisions related to fines and imprisonment in default of payment. When no specific fine amount is mentioned, it is unlimited but must not be excessive. Courts can impose imprisonment if fines are unpaid, with the term not exceeding one-fourth of the maximum imprisonment for the offense. For fines or community service defaults, imprisonment is simple and varies by fine amount: up to two months for fines under five thousand rupees, four months for fines under ten thousand rupees, and up to one year otherwise. Imprisonment ends when fines are paid or levied, and unpaid fines can be collected within six years of sentencing. The offender's death does not absolve the liability of their estate.
