of <h1>Definition of Resident Status Under Section 2(v) of FEMA 1999: Key Criteria and Burden of Proof Explained</h1> A resident, as defined by Section 2(v) of the FEMA 1999, is someone who has lived in India for more than 182 days during the previous financial year. However, this does not include individuals who have left India or remain outside for employment, business, or any purpose suggesting an indefinite stay abroad. Similarly, it excludes individuals who come to or stay in India without intentions of employment, business, or any purpose indicating an indefinite stay. The responsibility lies with the individual to prove their residential status if questioned by authorities.
