Recording of deposition under NCLAT Rules prescribes Form NCLAT-7, bench initials, and procedure for witness corrections.
Under the NCLAT Rules the recording of witness depositions is mandated to be in Form NCLAT-7, with each page initialled by the Members constituting the Bench; this prescribes a formal written record requirement. Corrections identified by the witness may be incorporated if the Bench is satisfied, and such amendments must be duly initialled, while if the Bench is not satisfied a note to that effect must be appended to the deposition, thereby prescribing a procedure for preservation of original entries and official notations of disputed alterations.
