Appearance of authorised representative under Companies Law permits professionals and authorised officers to represent parties; prescribes minimum officer rank.
Rule 63 provides that in appellate proceedings under the Companies Law a party may appear personally or authorise one or more chartered accountants, company secretaries, cost accountants, legal practitioners or any other person to present its case; this authorisation governs representation before the Appellate Tribunal. The Central Government, Regional Director, Registrar of Companies or Official Liquidator may authorise an officer or an advocate to represent them, and any officer so authorised must be of at least Junior Time Scale rank or be a company prosecutor, establishing minimum qualification and rank for official representation.
