Compounding Offences Under Sections 88 & 89 of Consumer Protection Act Allowed Before/After Prosecution with Court Approval
Offences under sections 88 and 89 of the Consumer Protection Act, 2019 can be compounded, either before or after prosecution, upon payment of a prescribed amount, not exceeding the maximum fine for the offence. Court approval is required if a complaint is filed. The Central Authority or its authorized officers may compound these offences. Compounding is not allowed for repeat offences within three years. If an offence is compounded, no further proceedings will occur, and acceptance of the compounding amount is considered an acquittal under the Code of Criminal Procedure, 1973.
