Section 58 - Jurisdiction of National Commission

Jurisdiction of National Commission: authority over high-value consumer complaints, appeals, and review of State Commission jurisdiction.

The National Commission has original jurisdiction over high-value consumer complaints, complaints against unfair contracts exceeding the statutory monetary threshold, and appeals from State Commissions and the Central Authority; it may call for records and pass orders where a State Commission has exceeded, failed to exercise, or acted illegally or with material irregularity in its jurisdiction. Jurisdiction is exercised by Benches constituted by the President, presided over by the senior-most member; differing opinions among Bench members are decided by majority or referred to the President for resolution, who must give an opinion within two months.
