Section 31 of Competition Act: Commission's Role in Approving or Modifying Combinations to Ensure Fair Competition.
Section 31 of the Competition Act, 2002, outlines the powers and duties of the Commission regarding combinations. If a combination is unlikely to adversely affect competition, the Commission will approve it. However, if it is likely to have an adverse effect, the Commission may disallow it or require modifications. If modifications are proposed and accepted, the combination may proceed. The Commission must decide within 150 days; otherwise, the combination is deemed approved. If a combination is voided, it is treated as if it never occurred under other laws. Existing proceedings under other laws remain unaffected.
