Section 53Q of Competition Act: Violating Tribunal Orders Leads to Contempt, Compensation Claims Possible for Non-Compliance.
Section 53Q of the Competition Act, 2002, addresses the contravention of orders issued by the Appellate Tribunal. If a person violates such orders without reasonable grounds, they face contempt proceedings under Section 53U. The Chief Metropolitan Magistrate in Delhi can only take cognizance of such offenses upon a complaint by an authorized officer of the Tribunal. Additionally, individuals can apply to the Tribunal for compensation recovery if they suffer loss or damage due to an enterprise's non-compliance or delay in complying with Tribunal orders. Amendments in 2023 updated these provisions.
