<h1>Individuals can seek compensation under Section 42A for losses from enterprises violating Competition Commission directives.</h1> Section 42A of the Competition Act, 2002, allows individuals to apply to the Appellate Tribunal for compensation if they suffer loss or damage due to an enterprise violating the Commission's directions or contravening its decisions or orders without reasonable grounds. This includes violations under sections 6, 27, 28, 31, 32, and 33, or any related conditions or restrictions. The provision was inserted by the Competition (Amendment) Act, 2007, and updated by the Competition (Amendment) Act, 2023, effective from September 10, 2024.
