<h1>Section 21 of Competition Act: Statutory Authorities Can Refer Contradictory Decisions to Competition Commission for Opinion.</h1> Section 21 of the Competition Act, 2002, outlines the process for statutory authorities to refer issues to the Competition Commission. If a party in a proceeding claims a decision by a statutory authority contradicts the Act, the authority may refer the issue to the Commission. Authorities can also make such references on their own initiative. Upon receiving a reference, the Commission must provide its opinion within sixty days. The statutory authority must then consider this opinion and record its findings with reasons on the referred issues. Amendments in 2007 and 2023 have refined these provisions.
