Competition Act Repeals MRTP Act; Transfers Cases and Employees to New Bodies, Retains Existing Rights
The Competition Act, 2002, repeals the Monopolies and Restrictive Trade Practices Act, 1969, dissolving the associated commission. Despite the repeal, actions, rights, and liabilities under the old Act remain unaffected. Employees of the dissolved commission are reassigned to the Competition Commission of India or the Appellate Tribunal, retaining their employment rights. Pending cases related to monopolistic or restrictive practices are transferred to the Appellate Tribunal, while unfair trade practices cases are moved to the National Commission under the Consumer Protection Act. Investigations are transferred to the appropriate bodies for continuation. Other pending cases abate unless specified otherwise.
