Non-compliance with Commission orders can trigger daily penalties and criminal sanctions including imprisonment or fines. Section 42 authorises the Commission to inquire into compliance and to impose a daily monetary penalty for failure, without reasonable cause, to comply with its orders, subject to an overall maximum; continued non-compliance or failure to pay the penalty attracts criminal sanctions including imprisonment or fine, and criminal proceedings may be taken only on a complaint by the Commission or an authorised officer.
