Notice completeness requirements: invalidation follows uncured defects, with cure opportunities, time exclusions and fee adjustment.
A notice under the Combinations Regulations is valid only if complete and conforming. The Commission may require parties to remove defects or furnish additional information; defects are to be communicated promptly and proof of service placed on record. Time taken to supply information or obtain third party information is excluded from specified statutory review periods. Failure to cure defects within the time specified renders the notice invalid, subject to an opportunity to be heard; on invalidation the Secretary must notify the notifier and may allow fee adjustment if a new notice is filed within a limited interval.
