Merger control transition: CCI combination provisions apply to transactions effective after commencement, subject to prior notice status.
The regulation provides that sub section (2) of section 6, sub section (4) of section 6, and section 6A of the Act apply to acquisitions, mergers or amalgamations coming into effect on or after the regulations' commencement, provided the transaction meets the Act's notification criteria and is not exempt as applicable on commencement where it previously did not require notice. It further specifies that the provision under section 43A will not apply to transaction parts effective before commencement if those parts previously did not require notice to the Commission.
