Online mediation may be conducted using electronic form or computer networks, including encrypted email, secure chat rooms, and audio or video conferencing, enabling legally valid remote conduct of the mediation process. The manner of conducting online mediation is to be as specified, prescribing procedural requirements for such mediations. Online mediation must be conducted only in circumstances that ensure the integrity of proceedings and continuous maintenance of confidentiality, and the mediator may take appropriate steps to secure these elements. Mediation communications in online mediation must ensure confidentiality, subject to the Act.
