Section 123: Acceptor can't deny drawer's authority on bills; bailees can't deny bailor's authority. Exceptions apply.
Section 123 of the Bharatiya Sakshya Adhiniyam, 2023, establishes that an acceptor of a bill of exchange cannot deny the authority of the drawer to draw or endorse the bill. Similarly, bailees and licensees cannot deny the authority of their bailor or licensor to initiate a bailment or grant a license. However, an acceptor may contest the authenticity of the drawer's identity, and a bailee may demonstrate that a third party had rights to the goods over the bailor if the goods were delivered to that third party.
