of <h1>Section 81: Courts to Presume Genuineness of Official Digital Records if Maintained and Produced from Proper Custody</h1> Section 81 of the Bharatiya Sakshya Adhiniyam, 2023, establishes that courts shall presume the genuineness of electronic or digital records purporting to be the Official Gazette or other legally mandated records if they are maintained substantially in the legally required form and are produced from proper custody. Proper custody is defined as the place and person legally designated for such records, though custody is not deemed improper if the origin is legitimate or circumstances suggest a probable legitimate origin.
